VICTORY – Summary Judgment and the Dismissal of all Claims in Nebraska State Court.
Henner & Scarbrough LLP is excited to announce another recent victory on behalf of its clients, securing summary judgment and the dismissal of all claims in Nebraska state court. The project at issue involved the construction and retrofitting of a food processing facility owned by a Fortune 500 food production company. The owner sued our clients and sought more than $90 million in damages based upon alter ego and agency theories of liability, as well as relief under the Uniform Voidable Transactions Act. After three years of discovery, including nearly 60 depositions of fact and expert witnesses, the court granted our motion for summary judgment in a written opinion and dismissed our clients from the case shortly before trial. Christopher Olsen argued the motion for summary judgment with Tyler Scarbrough assisting on the brief. Attorneys Nan Leverett and Joe Freeman were integral in providing key roles during the discovery phase of the dispute.
